1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Flamingo mobile application ("Flamingo", "the App"), published by Flamingo - Daily Habit Tracker ("we", "us"). By downloading, accessing, or using Flamingo, you agree to these Terms. If you do not agree, do not use the App.

2. Description of service

Flamingo is a habit-tracking application that helps you build and maintain daily routines through habit tracking, streaks, milestones, and reminders. Flamingo offers a free tier and optional paid subscriptions that unlock additional features.

3. Accounts

You can use Flamingo without an account, in which case your data stays on your device. To sync your data across devices, you may create an account using an email address. You are responsible for keeping your account credentials secure and for all activity under your account.

4. Subscriptions and billing

• Flamingo offers optional weekly and yearly auto-renewing subscriptions.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription any time in your Apple ID account settings.
• Refunds are handled by Apple in accordance with the App Store's refund policies; we do not process refunds directly.
• Prices may vary by region and are subject to change with notice where required by law.

5. Your content

You own the habit data you create in Flamingo. By syncing your data through an account, you grant us a limited license to store and process that data solely to provide the syncing and backup features of the App.

6. Acceptable use

You agree not to:

• Use Flamingo for any unlawful purpose or in violation of these Terms;
• Attempt to reverse engineer, decompile, or interfere with the App or its infrastructure;
• Access another user's account or data without authorization;
• Use automated means to access the App outside of its intended interface.

7. Intellectual property

Flamingo, its design, logo, and mascot are owned by Flamingo - Daily Habit Tracker and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

8. Not medical or professional advice

Flamingo is a personal productivity tool and is not a substitute for professional medical, psychological, or therapeutic advice. If you are struggling with habits related to your health or wellbeing, please consult a qualified professional.

9. Disclaimer of warranties

Flamingo is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that your data will never be lost, and we recommend not relying on Flamingo as your sole record of important information.

10. Limitation of liability

To the maximum extent permitted by law, Flamingo - Daily Habit Tracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Flamingo.

11. Termination

You may stop using Flamingo and delete your account at any time. We may suspend or terminate your access if you violate these Terms.

12. Changes to these terms

We may update these Terms from time to time. We will update the effective date above when we do. Continued use of Flamingo after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Türkiye, without regard to conflict of law principles.
